what you can expect at this hour and what you can expect for the afternoon coming up. >> and happening now a high srf advisory along bay area beaches on the heels of the tragic death of a man and boy who were swept out to sea. we are live in pacifica with more onto precautions people need to take today. >> reporter: you can hear and see the roar of the waves here behind us. we are next to the pacifica pier. there is a high surf advisory in effect until ten tonight. the weather service is predicting swells as high as ten to 14 feet. they are warning about strong rip currents and the potential for beach goers to be swept away. you can't see any beach. the waves are coming up the rocks. you wouldn't want to walk in this area. again they do have signs on the pier warning that even people walking along the paved area can get wet. the waves is break over the seawall. two people lost their lives yesterday when they were swept

out to sea. aman and a boy who haven't been identified yet were with at least one other adult yesterday when all three were carried out into the car. one of them was able to swim to shore and call the police. the coast guard and fire department respond. they found the manslaughter and child in the water but it was to late. both had died. i spoke to a coast guard representative who confirmed that the adult, the adults and the child had been fishing in the area at the time. investigators with want to warn the public to be very aware of the weather conditions before they head out anywhere near the water. >> watch all the weather patterns when you are so close to the surf line. watch what i high tides are. >> reporter: now again there is a high surf advisory for today. the waves are supposed to get bigger as the morning goes on. that high surf advisory will

remain in effect until ten tonight. one of the activities that the national weather service is warning against is fishing on rocks near the water. again that is what -- according to the coast guard the family was doing yesterday. the adult and child were carried out and then passed away and drowned because of it. the national weather service is putting out a warning, stay off the beach. stay off the rocks because of all the waiver activity expected today. live in pacifica. >> overnight news firefighters are investigating a fire at a bank in fremont. this is at the california bank and trust in the fremont hub. the bank was boarded up and a guard watched the property overnight just to protect the money inside. firefighters say they had to break-in to the bank to find the source of the flames and battle the fire. >> smoke coming from the roof. they forced president are you into the bank and there was a fire on the second floor. it was in the wall. >> took 40 minutes to get the

fire under control. who investigators were called into figure out what caused the fire. the bank will bet shut down for a few days until investigators can finish their work. >> police are searching for the gun men in two separate shootings. in the first a bullet wounded eyeing bystander. that happened just after 10:00 p.m. the female is listed in stable condition. a couple hours later at midnight a man was shot on the 1700 block of 13th street. he is in stable condition. no arrests have been made. a rising crime rate just one of the problems facing the new police consultant. he is expected to take over in february. he must also tackle issues that include staffing shortages and low morale but the da who worked with him in los angeles lives that he has a lot to offer. >> allow him to provide the knowledge base that is required in order to get oakland moving in the right direction.

. welcome back on this saturday morning. a live look at the cloudy start. it's a chilly one out there. a few lingering showers followed by dry weather fort afternoon. >> new this morning a passenger airliner crashed in russia. we want to show you the first pictures the crash site. a twin engine jet over shot the runway. it broke apart and caught fire. so far two people have died. there are conflicting reports at this hour on the number of injuries, they range from six to ten. that plane belonged to a russian airline called red wings. we will bring you new information throughout the morning. >> india authorities charged six men with murdering a woman they say what gang raped and and beat on a bus. dozens of people outraged over the attack are holding daily protests. they want greater protection

against violence toward women. the woman had massive internal injuries. she was airlifted to a hospital but died yesterday nearly two weeks after the attack. >> i can only assure the family that the government will take whatever steps are needed to ensure that the killers get the hardest punishment. >> and if convicted the six face the death penalty. >> a lawyer is asking for permission to sue the state of connecticut over the school shooting. he is doing it on behalf of a 6- year-old student who survived. the attorney said the girl was trauma was traumatized. the traumatized. many across the station continue to fight for stronger gun control laws. san rafaell's mayor is the

latest to join the effort. he put his name on a petition urging congress and the president to encase laws. other mayors are also thinking of putting their names on the list. >> police say there is been 500 homicides in chicago this year. the 500th victim was killed thursday night. there were 435 last year. they haven't seen this many since 2008. police say they blame gang violence and illegal guns. community leaders say they are struggling to curb violence in certain neighborhoods. >> if you grow up in one of these communities where violence is a learned behavior, it's the culture you have guy that plan out what they are going to do tonight what they are going to do tomorrow. they get into a slight altercation or beef they are going to take that person's life because they have been taught to do that. >> some say police and community leaders have to work harder to change attitudes

toward violence. >> congress is considering whether to provide more aid to the victims of hurricane sandy. the senate has passed a relief package, republicans argued the bill included to much money for unrelated aid projects. it struck in late october. it killed more than 250 people in seven different countries. the relief bill goes to the house and it's still unclear if the gop is going to vote on that or push for something else. 2012 has been a busy year for the red cross. the agency said it's responded to 113 large scale disasters in the united states. volunteers opened 900 shelters and helped more than 100,000 people who have been forced out of their homes. the agency said they were the most challenging. the aftermath prompted the biggest response in five-years. >> you heard of the fiscal cliff but what about the dairy cliff? milk prices could double next year and that's because a national farm bill expires on

january 1st. if lawmakers don't extend the bill it reverts to a 1949 law when the government and not the market controlled prices. because of old formulas used to set the price a gallon of milk could jump to six or eight dollars a gallon. >> the most important thing we use. if the prices group it affects our business. we are concerned and we keep watching the market. >> some experts are down playing the dairy cliff. they say that the agriculture department will stall until congress moves to keep prices down. the farm bill also provides foreign food aid and disaster relief. >> a public memorial is being planned for a local environmental leader who died this week on vacation. the 39-year-old served as executive director of the san francisco based marine force action network. she helped put together a landmark agreement with disney

that changed the way disney buys and uses paper. >> her incredible, smarts and talent and her way of negotiating with these big banks and then the next day being out in the street with protesters. >> she drowned wednesday after going for a swim in mexico. she adjacent got married in july. >> a woman was hit and killed by her own truck. the 60-year-old died yesterday on wilbur avenue. she had been working underneath a large truck, police say at some point her truck slipped in to gear and rolled her or pinning her underneath. firefighters say she was eventually pulled out but died at the scene. >> today is the last day drivers can park for free in oakland. the city has been offering free parking every saturday since thanksgiving. the goal was to boost the city's small businesses by letting shoppers park for free. there will be no charge to park at all city run meter spaces in four city owned garages.

. rough conditions out on the water as huge waves batter away in a bay your coastline. welcome back. >> good morning. there is a high surf advisory in effect right now. just a day after the death of two people swept out to sea. we are live this morning in pacifica with the current conditions out there. what's happening? >> reporter: we are standing next to the pacifica pier and you can see the wave behind us. you can hear them also.

it's pretty loud. these swells supposed to get as high as ten to 14 feet. there is a high surf advisory in effect until ten. right now you can see several people standing out on the pacifica pier fishing this morning. the pier is still open but in the past when we have had the high surf advisories we have senate city come out and close the gates, close public access and that's because of the potential for rogue waves to sweep over the pier. it's still open now but it may be closed later on this morning. now one incident that happened yesterday is a reminder of how dangerous the ocean can be. a man and boy died after being swept out to sea yesterday afternoon. a coast guard representative confirmed that at least two adults and the child had been fishing on the golden gate national rec area just north of the bridge. all three were carried out in to the water by a wave. one of the adults was able to swim back to shore and called

the police. rescuers went out and found the bodies of the man and young boy. investigators say they want to warn the public to be very aware of these dangerous weather conditions. >> know your limits and the area you are going into. our national parks are beautiful but they are unfor giving. >> there is a high surf advisory in effect. you do not want too be walking along this beach. in fact the national weather service is warning beach goers along the coast here in the bay area to -- there is a potential it can be swept out. avoid beach fronts like this. may warn that fishing on rocks near coastlines could be dangerous today because of all the wave activity. live in pacifica. ktvu. >> a teen who escape could while being drive tone a juvenile facility has been found and taken back into custody. he was caught trying to shoplift yesterday afternoon

near 4th and market streets. he did try to run but was caught by officers. police have been searching for him since wednesday when he jumped out of a moving vehicle that was taking him to a youth guidance center. he is now in juvenile hall. >> there is now a 6th suspect charged in the case of two people found bound and gagged on a street. news cameras weren't allowed in the courtroom as the 26th-year- old suspect cathryn wong became the next person charged. prosecutors charge the suspects assaulted the victims and killed one of them over a dispute involving credit card fraud. >> we are dealing people that obviously aren't hesitant to kill someone. they believe that -- they probably believe that they killed both the man and the woman. the woman survived. >> the police investigation turned up 40 to 50 blank credit cards, label makers and a list of credit card numbers and

security codes. four suspects including wong are jailed on two million dollars bail. a 7,500-dollar reward is offered to help police found the men who attacked a couple in west oakland . two men with guns beat a man unconscious and sexually assaulted his girlfriend on eddie street on december 8th. the suspects african american in their late 20s. one was 5'10'', thin with a mustache. the other 6'1'', both wore black hooded sweet shirts. >> in riverside investigators probably won't arrest the driver who hit four people at i bus stop. the car crashed into a bus stop. a 7-year-old girl and a 28-year- old woman were killed. though police detained the driver, they say there is a lack of intent or negligence. a driver has been arrest after hitting a sacramento home. he was speeding when he lost

control. he put a hole in the house and hit a gas meter. the people inside the home were not hurt but a few neighbor has to evacuate. police suspect the driver was drunk. >> there will be new rules on the road for california in the coming year drivers can text on their phones while driving as long as they use voice operated hands free technology. safety experts disapprove of the new law. each year some 5500 people are killed in crashes that involve distracted drivers there. are several driving laws taking effect on january 1st. currently drivers suspected of driving under the influence have the option of taking a breath, blood or urine test. that test is being eliminated. also new standards for red light cameras as well as an amber alert for seniors. the silver alert system is for missing people older than 65. >> law enforcement will be out in full force to make sure new

year's partyers don't start to early and get out of hand. several cities will all hold dui checkpoints tonight. police say research shows crashes involving alcohol, dropped by an average of 20% when well known checkpoints are conducted. drivers busted or dui say a new proposal won't work. jerry hill wants drivers convicted of a second dui to install locking devices in their cars. >> we have tried increasing fines. we have tried to revoke licenses to deter those offenders but we need to do more to save lives. >> the pure fact that these are considered multiple offenders means they are law breakers. >> the chp supports the locking devices but drivers say deter isn'ts are hit and miss and that the key to stopping them is to address why they decided to do so in the first place. >> if you are planning to go

place to be. >> the nearby boulevard restaurant will offer a prefixed meal with a midnight surprise. less expensive spots don't require reservations but arrive early and have a plan to get home because finding a cab could be hard. the show is free. it takes place monday at midnight. around 250,000 people are expected to line the area to ring in the new year. officials say mass transit is the best way to get there. police say they will enforce a ban on drinking in public. >> fireworks show always a blast. >> everybody wants clear skies for that. rosemary has been working on that for us. no pressure. >> we are expected to be mostly cloudy but hopefully not a lot of rain in the area and the clouds hopefully not so low that you won't be able to see. a weak system will bring a threat of precipitation, i should say rain. outside a threat of just a few scattered showers as well. a look out to the cloudy

conditions over the bay area this morning. it's a cool breezy start and again some of us still feeling a few sprinkles, many and most us are beginning to dry out. you may find the roadways still damp if you have an early morning drive be prepared. live look, you can see bits of rain continuing to fall the system moving to the south, moment ago this over highway 101 at coyote creek has moved to the east. i want to move east just a little bit and show you this pink and lighter shades of almost white. rain snow mix our areas of mount hamilton. areas above 3 you this feet getting a dusting of snow where we are finding that little bit of moisture, that probably will melt fairly fast but it's going to be a relatively cool day out there but mainly dry. here is a look at the storm. it stays off the coastline. you can see the flow bringing with it the scattered showers throughout the morning. this is shifting south and as

let's start with a quick check of weather with rosemary. good morning. >> good morning. that threat of rain over the area this morning is moving out as this system off the coastline continues to move toward the south picking up just a little bit of light rain, a few sprinkles with mostly cloudy skies over parts of the north bayh long the coastline in and around half moon bay. a few showers i have seen here in the last ten minutes or so. for the morning we will continue it just the few sprinkles. cold weather for the afternoon we will stay cool but dry and again a high surf advisory that we are talking about this morning. >> overnight news firefighters are investigating a fire at a bank in fremont. this is the california bank and trust on fremont boulevard. the bank was boarded up and the guard had to watch the property overnight to protect money inside. firefighters say they had to break-in to the bank to find the source of the flames and battle the fire. >> smoke coming the roof.

they forced entry in to the bank and there was a fire on the second floor. difficult to access. >> it took about 40 minutes to get the fire under control. two investigators were then called into figure out what caused the fire. the bank is going to be shut down for a few days so they can finish their work and repair. >> happening right now a high surf advisory is in effect for the bay area. want to show you video we shot in pacifica. the national weather service is predicting swells as high as ten to 14 feet. the advisory is set to exexpire at ten tonight. we will have a live report from pacifica coming up at 8:30. 8:30. a man and boy have died after being swept out to sea. we were there last night as the coast guard and fire rescue searched for the two near the marin head lands. the victim has been fishing another person when large waves swept them into the ocean.

that person was able to get out of the surf and was able to call for help. the man and boy were rescued but later died. >> i don't flow if it was a high tide that caused the accident. we are just trying to get education out to the public that know your tides, know your limits and go out with a good plan. >> the national park service park police and the coast guard will investigate what happened in this case. the marin county coroner is not identitying the victims until their families have been told. >> oakland police are searching for the gun plan in two separate late night shootings. in the first a stray bullet wounded a young girl. it happened after ten on 19th and franklin in downtown oakland. she is listed in stable condition. two hours later at midnight a man was shot several times on the 1700 block of 13 street. he too is listed in stable condition. no arrests have been made in either case. a rising crime rate is just one of the problems facing the new police consultant. the former police chief is

expected to take over in february and he is also going to have to tackle the issues. san francisco's district attorney who works with him in los angeles believes he has a lot to offer. >> allow him to provide the knowledge base that is required in order to quiet oakland moving in the right direction. >> he is going to help map out a crime reduction strategy through com stat which is a data and crime tracking system. >> washington lawmakers running out of time to reach a deal on this fiscal cliff. senate leaders are working on a last ditch agreement. they hope to vote on it as soon as tomorrow or monday. both houses will reconvene tomorrow. a main sticking point is tax increases on the wealthy. while some suggest raising taxes for those who earn a million the president wants increases on anyone making more

working. antioch police say at some point her truck slipped in to gear and rolled over her. firefighters say she was eventually pulled out but died at the scene. >> today in india authorities charged six men with gang raping and murdering a woman on a bus. dozens of people outraged over the attack are holding daily protests. they are demanding greater protections against violence toward woman. the victim had massive internal injuries. she was airlifted to the hospital and died yesterday. >> i can only show the family that the government will take whatever steps are needed to ensure that her killers get the hardest punishment. >> if convicted they face the death penalty. >> a grim milestone for the city of chicago. police say there have been five

. a warning to people who may want to go out on the water today, waves as high as 14 feet could hit the coast. good morning. welcome back. >> a high surf advisory is in effect until late tonight and we are live if pacifica watching the conditions there. >> reporter: we have been out here since five this morning and we have seen the waves get bigger as the morning goes on. there is a high surf advisory in effect for the coastal areas until ten tonight. the national weather service said these swells could get

between ten to 14 feet high. sometimes when we have high surf advisories the city will close down the pier. if you look in the distance you can see the white truck with the blinking lights. that's the city worker who was out here a short time ago. he talked to us and said he is keeping an eye on the waves out here. he may make the call to shut down the public access to the pier because high tide is at 11:00 this morning. depending on how things go people may not get access anymore. we just walked over and saw a lot of people fishing there this morning. they said the conditions for fishing crab are good when the weather is like this. some people said they were aware of this high surf advisory and said they wouldn't take a chance fishing on the shoreline in weather like this. >> i don't mesa round with the rocks, especially on days like this. you can see the waves in the background. they are pretty high. up here seems safe. >> we were expecting it to be a little bit calmer. we weren't aware of the advisory but we have been

watching the waves and they have been really hitting pretty hard. it makes it tougher. >> now a very sad incident that happened yesterday as a reminder of how dangerous the ocean can be. a man and a boy died after being swept out to sea jed afternoon around four. it happened near point bonita just north of the golden gate bridge. a coast guard spokeswoman said that the group had been fishing on the rocks when they were swept away by a large waiver. one of the adults was able to swim to shore and called the police for help. rescuers did find the bodies of the man and the child but they didn't survive unfortunately. back out here live you take a look there is a high surf advisory. you can see it. just very loud and visible here. this is in effect until ten o'clock this evening and 1346 the activities that the national weather service is warning people not to do today. they say beach goers could be

as a precaution. officials say their flood control project helped prevent maimingor fooding after several storms hit the area. without the added protections officials say downtown napa would have flooded. the project was paid for by tax dollars and the army corp. of engineers. they plan to rally for more funds to finish. >> a 75 fun dollar reward is being offered to help police find a man who attacked a couple. two men with guns beat a man unconscious and assaulted his girlfriend on eddie street. the suspects african american in their late 20s, one was 5'10'', thin with a mustache. >> now a 6th suspect charged in the case of two people found bound and gagged on a san francisco street. news cameras were not allowed as the suspect cathryn wong became the latest person charged in the attack. court papers describe her as a

convicted felon. prosecutors suggest that the suspects assaulted the two victims and killed one of them over a dispute involving credit card fraud. >> we are dealing people that obviously aren't hesitating to kill somebody. they believe -- they probably believed they killed both the man and woman. the woman survived. >> the police investigation turned up 40 to 50 blank credit cards, label makers and a list of codes. four of the six including wong are in jail on $2 million bail. >> in the city of riverside investigators will probably not arrest the driver who plowed in to four people waiting at a bus stop. the car crashed into a sign outside a store. a 7-year-old and a 28-year-old were killed and two are in the hospital with critical injuries. though police detained the driver they say there is a lack of intent or negligence. a driver has been arrested

with more on the precautions people should take. >> reporter: we've been out here since 5:00 this morning and we have sean the waves in pacifica get bigger as the morning goes on. there is a city of pacifica park ranger here, walk along the pier, monitoring the waves because he says if they get too high, if those waves start splashing the bottom of the pier out in the distance there, then he'll have to make the call to close the pier off to the public. >> if it starts hitting the bottom deck and that's when i need to call my supervisor and also the police department that i'm closing the pier. that's our protocol. >> reporter: there is a high surf advisory in effect today until 10:00 p.m. the national weather service says the as well as will get between 10 to 14 feet high. now, according to the park ranger out here, high tide is at 11:54, so the waves are going to be getting bigger as the morning goes on. we walked over to the end of the

pier and saw a lot of people fishing there this morning. themed the conditions for fishing crab and other items are pretty good when the weather is like this. some people we talked to said they were aware of the advisory and said the waves did look very impressive to them. >> i think it is a concern for a lot of people, with waves like this. you can't really predict the ocean. >> reporter: now, a tragic incident yesterday is a reminder of how dangerous and unpredictable the ocean can be a man and boy died after being swept out to sea yesterday afternoon. it happened around 4:00 near point bonita on the golden gate national recreation area, north of the golden gate bridge. a coastguard spokeswoman confirmed for us this morning that the man and the boy had been fishing when they were carried away by a large wave. they were there with another adult who managed to swim to shore and called 911 for help. rescuers did find the man and the child, but they did not survive. again, as part of their advisory today, the national weather service is recommending people avoid beaches and taking a look

out here, you can see why. there isn't really a beach here to even walk on. they also say you should avoid fishing on rocks along the coast lines today. that's because of the danger, the potential of getting swept out by a large wave. live in pacifica, allie rasmus, ktvu channel 2news. firefighters are investigating a fire at a bank in fremont. it is at a california bank of trust on fremont boulevard in the fremont hub. overnight, the bank was boarded up and a guard watched the property to protect the money inside. firefighters say they had to break into the bank to find the source of the flames and battle that two-alarm fire. >> smoke coming from the roof. made forceful entry into the bank. there was a fire on the second floor. difficult for us to act because it was in the wall. >> it took 40 minutes for them to get the fire under control. two investigators were called in to figure out the cause. the bank will be shut down for a few days so investigators can finish their work and so that repairs can be made. oakland police are searching

for a gunman in two separate light night shooting. in the first, a bullet wound add young bystanders on 19th and franklin streets in downtown oakland. the female victim is listed in stable condition. a couple hours later, at midnight, a man was shot in the 1700 block of 13th street. he is listed in stable condition. no arrests have been made in either case. well, a rising crime rate is just one of the problems facing oakland's new police consultant. former los angeles police chief bill bratton is expected to take over in february and he is also going to look at issues that include staffing shortages and low morale. but san francisco's district attorney, who did work with him in los angeles, believes bratton has a lot to offer. >> if they allow him to provide the knowledge base that is required in order to get oakland moving in the right direction. >> bratton is going to help map out a crime reduction strategy through com stat, which is a data and crime tracking system he developed. washington lawmakers are running out of time to reach a

deal on the so-called fiscal cliff. senate leaders are working on a last-ditch bipartisan agreement. they hope to vote on it as soon as tomorrow, possibly monday. both houses of congress will reconvene tomorrow. the main sticking point remains tax increases on the wealthy. while some republicans suggest raising taxes for those earning at least a million, president obama and democrats want increases on anyone making more than $250,000 a year. >> we just can't afford a politically self-inflicted wound to our economy. the economy is growing, but keeping it that way means that the folks you sent to washington have to do their jobs. >> in this morning's weekly address, the president says congress must meet the new year's deadline and pass a balanced plan that offers middle class tax cuts and reduces spending in a responsible manner. >> the president's proposal to raise taxes on the top 2% of americans won't even pay one third of the annual interest that's now owed on this massive $16 trillion debt.

>> missouri senator roy blunt delivered the gop weekly address, saying the president's tax hike would only fund the government for eight days. if no deal is reached, giving you a look at what could happen, 1.2 million out of work americans will lose their extended unemployment benefits. california would be hit the hardest. 400,000 will lose those benefits and the bay area will certainly feel the sting. more than 22,000 people in alameda and contra costa counties could be affected. california is bracing for a stalemate. the state controller's office is advising the departments use 2001 tax rates to calculate the next round of state worker paychecks. social security specifically will take out an extra 2%. if the so-called fiscal cliff is averted, the state will reimburse workers. payroll experts are telling private employers to wait for irs instructions and are advising workers to keep an eye out on their deductions. new this morning, another winter storm expected to dump several inches of snow on the east coast today. showing you new video of the

[ crowds protesting ] >> reporter: dozens of people outraged over the attack are holding daily protests, demanding greater protection against violence towards women. the 23-year-old victim suffered massive internal injuries. she was air lifted to a singapore hospital, but died yesterday, nearly two weeks after the attack. if convicted. the six suspects face the death penalty. a lawyer is asking for permission to sue the state of connecticut over the newtown school shooting, on behalf of a 6-year-old sandy hook student who survived the shooting. the attorney says the girl was traumatized after the confrontation with gunman adam lanza came over the loud speaker. he accuses the state of failing to protect students from what he calls foreseeable harm. the state has immunity against most lawsuits, unless permission is granted. many people across the nation continue to fight for stronger gun control laws. san rafael's mayor is the latest to join the effort. he's put his name on a nationwide petition urging congress and the president to

boost gun trafficking laws and get rid of military-style assault weapons. other marin county mayors are also thinking about adding their names to the list. a grim milestone for the city of chicago. police say there have now been 500 homicides this year. the latest victim, an alleged gang member was killed on thursday night. there were 435 homicides in chicago last year and the city hasn't seen this many killings since 2008. police blame gang violence and illegal guns, while community leaders say they are struggling to curb rye lent tendencies in certain neighborhoods. >> if you grow up in one of these communities where violence is a learned behavior, the culture of that community, you have guys who premeditate what they are going to do tonight, what they are going to do tomorrow. they get into a slight altercation or a beef with somebody, they are going take that person's life because they have been taught to do that. >> some residents say police and community leaders have to work harder to change attitudes towards violence. congress is considering whether to provide more aid to the victims of hurricane sandy.

a u.s. senate passed a $60 billion relief package yesterday. however, republicans argued the bill included too much money for unrelated aid projects. sandy struck the caribbean and the u.s. eastern seaboard back in late october. the storm killed more than 250 people in seven different counties. the relief bill now goes to the house. it is unclear if the gop in the house will vote on the measure or push for an alternative with less funding. 2012 has been a busy year for the red cross. the agency says it has responded to 113 large scale disasters in the united states. volunteers opened 900 shelters and helped more than 100,000 people who had been forced out of their homes. the agency says superstorm sandy was the most challenging. the aftermath of that storm

prompted the biggest response from the red cross in five years. you've heard of the so-called fiscal cliff, but how about the dairy cliff? milk prices could double next year because a national farm bill expires on january 1st. if lawmakers do not extend that bill it, reverts to 1949 law when the government and not the market controlled prices. because of antiquated formulas used to set the price, a gallon of milk which now costs close to $4 in most places could jump to 6 or possibly even $8. >> it's the most important ingredient we use. if prices go up, it definitely affects our business. we're definitely concerned and we keep our eyes on the market. >> but some experts are downplaying the dairy cliff,

saying the agriculture department will stall until congress moves to keep prices down. the farm bill provides disaster relief for farmers. gay couples are now allowed to marry in the state of maine. [ applause ] >> this is video of the first gay couple to wed in portland, main. the two exchanged vows in the city clerk's office just after midnight when the new law took effect. voters in maine, washington state, and maryland approved gay marriage in november. gay marriage ceremonies began in washington state earlier this month. maryland's law takes effect on tuesday. the idaho republican u.s. senator arrested on suspicion of dui says he does not plan to fight the charges when he

appears in court next month. police say mike crople had a blood alcohol level of 0.11% when he was pulled over early sunday in alexandria, virginia. a secondary blood alcohol test in jail shows he register add higher level an hour after being arrested. in a statement, the senator apologized for his actions. well, governor jerry brown has checked off most of his to-do list for 2012. he still has a lot of work ahead in the new year. at the top of his agenda, a massive water infrastructure project for the sacramento-san joaquin delta and making sure the nation's first high speed

rail system gets on the tracks. brown says he is excited for the new year and hopes to keep state spending under control. if you've been to the gas station recently, you may have noticed prices inching up. according to aaa, many stations in the bay area have seen prices go up about 4-cents a gallon in the past week. the average cost for regular unleaded fuel in california is now at $3.54 a gallon. the increase comes after a two-month decrease at the pumps, with

. >> lot of broken leashes, as you can see. people are losing boards and having to swim in. dangerous waves along the coast. why people are being urged to stay out of the water. good morning. welcome to mornings on 2, saturday december 29th. i'm claudine wong. >> i'm mike mibach. the national weather service has issued a high surf advisory along the coast. waves of up to 14 feet are expected on beaches today and parts of tomorrow. the surf is expected to cause

strong currents, which can pose a threat to swimmers, as well as surfers. people are being advised to stay out of the water. yesterday, a man and a boy died after being swept out to sea, outside the golden gate. the victims had been fishing with another person when large waves swept them right into the ocean. investigators say that person was able to get out of the surf and call for help. coming up at 9:45, ktvu's allie rasmus will have more about the warning from the coastguard and how you can stay safe. people living near the creek in morgan hill are being warned more water is coming their way. the creek is full and is spilling over. the valley district is releasing water from area reservoirs, so there's concern that more rain might cause flooding. >> it was very low, and in these past two storms we've had, it really rose quickly and it's full. it's going over the spillway now. >> water officials say the spillways are designed for much more water flow.

they have notified people living downstream of the water release as precaution. officials in napa county say their flood control project helped prevent major flooding after storms passed through the area that month. without the added -- the county plans to rally for more funds from the government to finish up the project. we have new video of a major injury-accident on vasco road. chp says it started around 6:00 this morning when a truck hauling broken glass dumped a large amount of glass onto the road south of brentwood near byron. two cars spun out, right into the glass. one car hit another that was on the side of the road. two people were hurt. the driver of the car that was hit suffered major injuries and was transported to the hospital by helicopter. there's now a sixth suspect charged in the case of two people found bound and gag order a san francisco street. news cameras were not allowed in the courtroom as the 26-year-old suspect, catharine wong, became the latest person charged in the

attack. court papers describe her as a convicted felon, nick named "killer." prosecutors suggest the two ended up killing the victim in a dispute over credit card fraud. >> we're dealing with people who are obviously not hesitant to kill people. they believe -- they probably believe they would kill both the men and the women. the women survived. >> the police investigation turned up 40 to 50 blank credit cards, label makers and a list of credit card numbers and security codes. four of the suspects, including wong, are jailed on $2 million bail. in the city of riverside, investigators will probably not arrest the driver who plowed into four people waiting at a bus stop. the car ended up crashing into a sign outside a michael's arts and crafts store. a 7-year-old girl and a 28-year-old woman were killed. two other victims are in the hospital with critical injuries. although police detained the 45-year-old driver, they say there is a lack of intent or

negligence. there are a series of new driving rules in california at the start of the new year. motorists can text on their phones while driving, as long as they use voice-operated hands-free technology. safety experts disapprove of that new law. each year, some 5500 people are killed in crashes that involve distracted drivers. there are numerous driving laws taking effect on january 1st. currently, motorists suspected of driving under the influence have the option of taking a breath, blood, or urine test. the urine test is being eliminated. there will also be new statewide standards for red light cameras, as well as an amber alert for seniors. the silver alert system is for missing people older than 65. law enforcement will be out in full force this weekend to make sure new year's eve revelers don't start early or get out of hand. several bay area cities, including san francisco, redwood city, mountain view and concord will hold dui check points tonight. police say research shows

crashes involving alcohol dropped by an average of 20% when well-publicized check points are conducted. motorists busted for dui say a new proposal cracking down on repeat drunk drivers isn't going to work. san mateo senator jerry hill wants alcohol breathalyzer locking devices installed in cars. >> we've tried to revoke licenses to deter chronic offenders, but we need to do more to save lives. >> the pure fact these are considered multiple offenders means they are ha habitual law breakers. >> deterrents are hit or miss and the key to stopping them from driving drunk is to address why they chose to do so in the first place. hundreds of thousands of people are expected to head to san francisco for the new year's eve fireworks show, to be shot from barges a thousand feet off pier 14. right across the street, the americana restaurant and the

hotel is planning a party in a see-through tent. dinner and prime seat for the midnight light show will cost $150 per person. >> we're going to have 300 people on our patio. fireworks are directly out in front. and it's just a great place to be. >> the nearby boulevard restaurant will offer a meal with a midnight surprise. less expensive spots don't require reservations, but you'll need to arrive early and have a plan to get home. finding a cab will be tough. as for the fireworks show it, is free and takes place monday at midnight. around 250,000 people are expected to line the embarcadero to ring in the new year. officials say mass transit is the best way to get there. police say they will be enforcing a ban on drinking in public. if you plan on being out and about new year's eve, bart and other transit providers are extending their service. additional bart trains will go in and out of san francisco monday night. service has been extended until 3:00 tuesday morning.

the extra service will aim to alleviate crowds at embarcadero and montgomery street stations where a lot of people are expected to watch the fireworks show. muni service is free from 8:00 p.m. new year's eve until 6:00 a.m. january 1st. caltrain and sun trans are free after 11:00 p.m. on new year's eve. shaping up to be a partly cloudy, dry day over the bay area. higher peaks picking up a little bit of rain and snow this morning over mount hamilton, right about 4200 feet. picked up some snow there. just a little blanket of snow. perhaps an inch or two over mount hamilton. this is the system that has been bringing us cloudy conditions and sporadic rain for the last 24 hours or so. it's shifting east and going to take rain wit it as it continues through the morning hours. by afternoon, we'll be partly cloudy and we will be dry. in fact, i want to point you to

face-off against number 2 ranked uconn huskies. both teams are undefeated and ranked at the top. well, stanford will have plenty of support at the rose bowl. according to the school, 38,900 stanford fans bought tickets for tuesday's game, while only 16,500 were sold in wisconsin. it's been 13 years since stanford made an appearance at the rose bowl. the team continues to prepare for the big game. yesterday, they practiced at the home depot center there in los angeles. preparations are also under way for the 124th annual rose parade. volunteers are busy putting those final touches on the floats. this year's theme, oh, the places you'll go, ipired by dr. seuss. military canines will also be a big part of this year's parade. people won't be able to stakeout those spots, though, on the parade route until noon time monday. more than 700,000 folks are expected to attend. today is the last day

drivers can park for free in oakland. the city has been offering free parking every saturday since the thanksgiving holiday. the goal, give a boost to the city's small businesses. now, there will be no charge to park at all city-run meter spaces and in the four city-owned garages. drivers will get free parking for two hours. tomorrow is the last sunday drivers in san francisco can park for free. starting next month, all city meters will be enforced from noon until 6:00 p.m. on sundays. the city says paid parking is necessary because commercial districts are now just as busy on sundays as they are on saturdays. meters in tourist areas, such as fisherman's wharf already charge seven days a week from 7:00 a.m. to 11:00 p.m. some people in alameda county will have to pay more the next time they actually go to the grocery store. we'll tell you about the new fee you will have to pay to check out. >> reporter: a high surf advisory is in effect for the coast for the entire day. we'll tell you how high these waves are supposed to get. >> plus, we are following

an hup date on breaking news we first told you about 20 minutes ago in oakland. a kayaker found the body of a man in the middle of the estuary. you are taking a live look at the docks. this is a picture from our ktvu tower cam. the bottom of your screen there, you can see oakland police officers standing there. earlier, we could see the yellow tarp near where they are. officers tell us the kayaker took the body to those docks and then called police for help. it's unclear at this point how that person died. there was no identification on

the body. and right now, no one at the waterfront recognizes him. so this investigation will continue. as you can see again, a body found in the estuary in oakland. time now, 9:44. let's recap top stories this morning. another winter storm expected to dump several inches of snow on the east coast today. 2 to 4 inches expected to snow from southern illinois to new jersey. forecasters say the storm is expected to be smaller, though, than the last one they did have. firefighters, vechting a fire at a bank in fremont. it happened at the california bank and trust on fremont boulevard. the bank was boarded up and a guard watched the property overnight to protect the money inside. arizona state and navy held a pep rally ahead of today's kraft fight hunger bowl in san francisco. some 33,000 tickets have been sold. for every ticket bought, kraft will donate a meal to the san francisco food bank, foundation and st. anthony's. well, there are big waves in the bay area today, a day after authorities say a wave swept a man and a child into the ocean

near the golden gate bridge, causing their deaths. allie rasmus joins us right now with a warning for those in and around the water today. >> reporter: well, the sun is out, the rain is gone, and there's quite a few people out here walking next to the pacifica pier. good thing they are walking on the paved area and not on the beach. that's because there is a high surf advisory in effect today until 10:00. the national weather service says as well as will get between 10 and 14 feet high today. high tide is 11:54 this morning. the waves you're looking at now will get more impressive as the morning goes on. sometimes when we have high surf advisories along the coast, the city will shut down the pier to the public for safety reasons. and there is a park ranger monitoring the waves right now. he told us he may close down this pier to the public as we get closer to noon, which is when high tide is expected. there are a number of people on the pier right now, fishing for crab. lot of them have been here since the pier opened at 4:00 this morning. some people we talked to said they were aware of this high

surf advisory. others were not. just about everyone on the pier agreed the waves looked pretty impressive today. >> i've been actually paying attention to it quite a bit, just to see, you know, what the waves are. a friend of mine, last time we came out here, they closed the pier because the waves were so high. >> we expected it to be a little calmer today. we weren't aware of the advisory when we first came out, but we've been watching the waves and they have been hitting pretty hard. makes it a little tougher out here today. >> reporter: a tragic incident yesterday, a reminder of how dangerous and unpredictable the ocean can be. a man and boy died after being swept out to sea yesterday afternoon. it happened near point bonita on the golden gate national recreation area, just north of the golden gate bridge. a coastguard spokeswoman confirmed for me this morning that at least two adults and the child had been fishing on the rocks when all three were carried away by a large wave. one of the adults swam to shore and was able to call 911.

rescuers did find the bodies of the man and the child, but did not survive. again, people with the coastguard and national weather service are making sure people in the coastal areas are very aware of the weather conditions. this high surf advisory is in effect until 10:00 tonight and the weather service says some of the things people should avoid today because of the wave conditions are fishing on the rocks or walking along the beach. they say there's a potential for people to get swept out to sea because of the wave activity today. live in pacifica, allie rasmus, ktvu channel 2news. new this morning, russian investigators now say initial indications point to pilot error for the cause of the deadly plane crash in moscow. at least four people died when the twin engine plane overshot the runway, while trying to land. the jet deteriorated and the cockpit was sheared from the fuselage. investigators won't say why they think it was human error. the plane can carry 210 people, but did not have passengers on board. it was returning from the czech

republic. also new this morning, there were no injuries when lightning struck a plane headed from japan to los angeles. the delta air lines flight made an emergency landing this morning at lax. we're told firefighters met that plane when it touched down. the pilots had declared an emergency before bringing that aircraft safely to the ground. and an unknown cruise sickness has made more than 200 people ill. it's happening on the queen mary 2, which left brooklyn on saturday. federal health officials say some kind of bug is causing vomiting and diarrhea. it is suspected to be the norovirus and the ship is now docked in the caribbean, set to return to brooklyn on thursday. the u.s. state department is warning americans traveling to haiti, the new tourist advisory saying people are vulnerable to getting kidnapped, regardless of occupation, nationality, gender or age. at least two americans were shot and killed during robberies orchid nappings in haiti this year. the u.s. is also warning travelers about the spread of cholera. a public memorial being planned for a bay area

environmental leader who died suddenly this week while on vacation. 39-year-old rebecca tarbutton served as the executive director of the san francisco bay's rain action network. she recently helped put together a landmark agreement with disney, which changes the way disney buys and uses paper. >> her incredible smarts and talent and her way of negotiating with, you know, these big banks and then the next day being out in the streets with protesters. >> authorities say tarbutten drowned wednesday after going for a swim in mexico. she just got married in july. berkeley fire department has a new leader this morning. chief debra priers retired after 27 years with the department. she broke numerous barriers. the 51-year-old was berkeley's first female firefighter, its first female chief, and the second black female fire chief in the country. the newlywed wants to spend more time with her husband. deputy chief gill dong will leave the department

temporarily. and would-be parents here in the bay area are still holding out hope that somehow they are going to be able to adopt children from russia. that is despite a new law just signed by russian president vladimir putin. he signed it yesterday, banning american families from making adoptions. in san francisco, a woman who asked us not to identify her is already halfway through the adoption process and she says she is not giving up. there is a 3-year-old girl waiting for her at a russian orphanage. >> i love my daughter very much. i miss her. i want to be reunited with her and i want to bring her home. >> she is trying to be very optimistic, saying, it's going to happen. i'm sitting here thinking saying, oh, my gosh, i'm sure this might not happen. >> adoption ages are trying to figure out how to proceed. they have already start and online petition and are contacting families to try to start a letter-writing campaign. a labor strike that some say could cripple the u.s. economy could be averted for at least

another month. long shore workers have agreed to a 30-day contract extension. a walkout threatened for tomorrow could have idled ports that handle about 40% of all u.s. container cargo. a federal mediator says he is cautiously optimistic an agreement could be reached in the next month. well, in just a few days, people in alameda county will have to pay for bags when they go to the grocery store. on january 1st, the county will join san francisco, san mateo county, san jose, and 49 other california cities in banning plastic bags. that means people will have to bring their own reusable bags to the store or pay up to 10-cents for a paper bag. a south san francisco retiree is now a multimillionaire. robert malino won a $23 million superlotto plus jackpot on a ticket that he bought a week ago at the sunshine center pharmacy. now, he says he didn't know he had won until thursday when a friend reminded him to check that ticket. he says he still hasn't decided

breaking news. new york city police now say they have a suspect in custody in the death of a man who was shoved in front of a speeding subway train. a police spokesman says detectives questioned a woman and said she had made statements implicating herself in the thursday night killing. security cameras helped police find the suspect. and comedian kat williams has been arrested at his los angeles area home on suspicion of felony child endangerment. tmz reports guns and drugs were found in the house. williams is being held in lieu of $100,000 bail. the comedian has been arrested several times in just the past

few months and the irs recently filed a $4 million tax lien against him. the national hockey league has made a new offer to its players, as the lockout enters a critical stage. today, the nhl and players association are expected to hold a phone conference about the proposed deal. the offer was still being reviewed by the union late last night and details of the plan are not being released. the league would like to have a deal in place by january 11th, so training camps can begin the following week. both sides are planning to meet in new york tomorrow. well, tonight, the golden state warriors play their final game of 2012, hosting the boston celtics at oracle arena. the warriors, now 20-10 on the year with their win over the 76ers last night, the first time golden state has reached 20 wins before new year's day since 1980. david lee finished the game with a double-double, 25 points, 12 boards. the warriors' first game of the new year will be wednesday against the hottest team in the nba, the l.a. clippers.
